Terms & Conditions of Sale
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING YOUR ORDER.
We may change these Terms & Conditions of Sale without prior notice.
1. Terms of the Contract
These Terms & Conditions of Sale apply to all goods supplied by Aromanesque.
Any order placed by you for goods advertised on our website is considered an offer by you to purchase the goods in your order. No contract exists between you and us until we have received and accepted your order. Each time you place an order, you will receive an automated email confirming this. The notification of receipt is not a confirmation, that the order has been accepted.
All customers that buy our products are in agreement with our terms. The contract is subject to your right of cancellation (see condition below).
We reserve the right to terminate the contract of sale if the full payment for the ordered goods is not received.
2. Description and Price of Goods
We have taken every care to describe and show all items as accurately as possible, and in accordance with the manufacturer's specifications. Despite this, a slight variation in items may occur. We provide you with product information on the website. If there is anything, which you do not understand, or if you wish to obtain further information, please get in touch with our Customer Service via the contact us form or e-mail.
Prices on the website are in EURO (€) Tax included, We make every effort to keep the prices on our website up to date, however, any changes to said prices are subject to change without notice.
Every effort is made to ensure the prices shown on the website are accurate at the time of placing an order. If an underpriced error item has been added to your shopping cart, we will reserve the right to stop the process and remove the underpriced item from your order. Any payment received from you with respect to the canceled item(s) will be credited back to your original method of payment.
If within 3 working days of accepting your order, we discover that all of the items are unavailable, we will email you to request if you would like an alternative item or refund. If a refund is chosen, it will be processed within 3 working days. If we do not receive a reply within 14 working days, the order will be canceled and refunded in full. The refund will be credited back to your original method of payment.
If within 3 days of accepting your order, we discover some - but not all of the items - are unavailable, we will contact you and offer you the option of amending your order to substitute the unavailable item(s) with applicable alternative goods. If you do not choose a substitute alternative within 3 working days, and the unavailable items total 20% or less of the number of items ordered, the unavailable item(s) will be removed from your order and we will dispatch the available goods. Any payment received from you with respect to the canceled item(s) will be credited back to your original method of payment. Aromanesque will not substitute an item without contacting you first regarding your order(s).
— Please note: We make every effort to keep the supplies as uninterrupted as possible. Due to the large scale of operations involved in the continuity of stock supply, we cannot guarantee all items will be available to order. Warehouses Inventory update errors might happen, although it is rare.
We use new and recycled packaging for sending our orders. We do not provide a gift-wrapping service. Depending on the size of the order, the items get delivered in unmarked and recycled boxes, as we do not want to generate more litter, than necessary.
3. Payment
The price of an item does not include the delivery charge. Payment shall be due before the despatch of goods. If your payment fails, your order will be automatically canceled. No goods will be despatched until payment has been made in full, and the funds have cleared.
4. Delivery
Delivery will be made to the address specified through our checkout when you complete your order. Once an order has been placed, we are unable to make any changes. This includes amending the delivery address, and shipping method, or removing items from the order.
If the delivery of the order will be refused, or it fails due to you canceling the contract, by exercising your right to cancel, you are required to return the goods, at your own cost, to us, as new. Please refer to our return procedure. If you fail to return the goods within 14 days, we reserve the right to charge you for any costs incurred during retrieving the goods from you.
Orders are aimed to be delivered within 2-5 working days after despatch. Please note a working day is any day other than weekends and Bank or other Public Holidays. We make every effort to ensure goods are delivered within five working days of acceptance of your order. However, Aromanesque will not be liable for any loss or damage suffered by you through a reasonable or unavoidable delay in delivery. In this event, we will inform you of any delays as soon as possible.
Please ensure you provide a delivery address, where someone will be available to receive the delivery. If the couriers are unable to complete a delivery due to nobody being present, a calling card will be left asking you to contact them directly to arrange a re-delivery. In the event of re-despatching the goods or in the event of redirection, further charges may apply.
Aromanesque retains ownership of all goods shipped within the EU & abroad until they have been delivered and signed for or left in a safe place by the courier. Once your goods have been delivered, the risk of damage or loss of the item passes to the recipient. When an item is shipped outside of the EU, the end receiver is liable to any and all customs charges and/or local release charges. In the case of these deliveries, ownership of the goods transfers to the end receiver when the goods arrive in the destination country.
5. Your Right of Cancellation
You have the right to cancel your contract with us at any time up to 14 days after receipt of your goods, in line with your statutory rights. To cancel your contract, you must advise us in writing, either by e-mail or by using the Contact Us page of the website. Should you wish to cancel your contract after the goods have been despatched to you, you will be responsible for returning the goods to us within 14 days, at your own cost, in their original packaging and as new, unless the goods are faulty, or damaged. — Please see our Refund Policy & Returns Procedure.
The exclusion of the right of cancellation applies if we have stated the exclusion in the offer, or in any case, well in advance of concluding the agreement. Articles that are personalized, that are clearly personal, and intimate in nature; cannot be returned.
6. Limitation of Liability
Aromanesque will not be liable to you for any loss or damage in circumstances where:
- There is no breach of a legal duty owed to you by Aromanesque or by its employees or agents;
- Such loss or damage is not a reasonably foreseeable result of any such breach;
- Any increase in loss or damage resulting from breach by you of any item of this contract.
7. Data Protection
Aromanesque will take all reasonable precautions to keep the details of your order and payment secure. However, we will not be liable for unauthorized access to information supplied by you. We will not supply your details to any third party.
8. Images
All though all effort is made to update product images on a regular basis, product images are for illustrative purposes and may differ from the actual product due to lightning environments. Please note there will be variations in colors pertaining to products manufactured from natural materials. No replacements or refunds will be made if a customer is dissatisfied with the color of a product.
9. Placing an Order
By placing an order with us, you are confirming you have read and agree to the terms, conditions, and delivery times as laid out in writing on this site. The contract of the sale is bound by the terms laid out in these sections and paragraphs.
10. Cosmetic Goods
All of our products intended for cosmetic use are certified and tested as required by law, and ingredients for any of these items are available on any product, online, and upon request. We recommend that end users of these products perform a patch test before using cosmetic products for the first time.
All Aromanesque products are formulated with clean ingredients and checked for safety, but they have not been specifically tested on pregnant or breastfeeding women. For those pregnant or breastfeeding we recommend checking the ingredients list of any product with a doctor to address any concerns.
11. Misuse of Goods
